Participant Agreement, Liability Waiver, and Assumption of Risk

Notice: This is a legally binding document. Please read it carefully and in its entirety before signing. By signing this agreement, you are giving up certain legal rights, including the right to sue.

This Participant Agreement, Liability Waiver, and Assumption of Risk (the “Agreement”) is entered into by the undersigned participant (“Participant”) in favor of Roller Coast-Tours, LLC, its owners, officers, directors, employees, volunteers, agents, and representatives (collectively, “the Company”).

In consideration for being permitted to participate in the tour described above, and any related events and activities (collectively, the “Tour”), I, the undersigned Participant, hereby acknowledge, understand, and agree to the following:

1. Acknowledgment and Assumption of Inherent Risks

I understand that participating in the Tour involves inherent risks, dangers, and hazards. The Tour includes travel by motor coach and visits to amusement parks and theme parks, which are activities with risks that cannot be entirely eliminated, regardless of the care taken to avoid injuries. I acknowledge that the risks include, but are not limited to:

Amusement Park Risks: Risks associated with riding high-speed roller coasters and other amusement rides, including G-forces, rapid directional changes, sudden stops, and potential for mechanical or operator error. This may result in slips, falls, collisions, neck or back injuries, heart failure, and other serious personal injuries, including permanent disability or death.

Transportation Risks: Risks associated with travel by bus, van, or other vehicles, including traffic accidents, sudden stops, and injuries related to boarding or disembarking.

General Risks: Risks of slips, falls, food poisoning, illness (including exposure to communicable diseases), insect bites, sunburn, dehydration, lost or stolen property, and unforeseen events or “acts of God.”

I hereby freely and expressly assume and accept all risks, both known and unknown, associated with my participation in the Tour, even if arising from the negligence of the Company or others, and I assume full responsibility for my participation.

2. Voluntary Participation & Health

I confirm that I am participating in the Tour voluntarily and of my own free will. I certify that I am in good physical health and have no medical conditions that would prevent my full participation in these activities. I agree to disclose in writing any pre-existing medical, physical, or mental health conditions that may affect my ability to safely participate in the Tour’s activities. I acknowledge that my failure to disclose such information may result in my inability to participate in certain activities and does not make the Company liable for any resulting injuries.

3. Participant Conduct and Responsibilities

Code of Conduct: I agree to act in a respectful and safe manner at all times and to abide by the Company’s code of conduct. The Company reserves the right to terminate my participation in the Tour, without refund, if my behavior is deemed to be disruptive, dangerous, or in violation of local laws or amusement park regulations.

Baggage and Personal Property: I acknowledge that I am solely responsible for my personal property, including but not limited to, luggage, electronic devices, and wallets. The Company is not responsible for any loss, theft, or damage to personal property at any time during the Tour, including items left on transportation vehicles.

4. Release of Liability and Covenant Not to Sue

On behalf of myself, my heirs, assigns, personal representatives, and next of kin, I hereby release, waive, and discharge Roller Coast-Tours, LLC from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the Company or otherwise, while participating in the Tour, or while in, on, or upon the premises where the Tour activities are being conducted.

5. Baggage Policy

Each participant (“Participant”) is permitted to bring one (1) large suitcase and one (1) personal carry-on item (such as a backpack or purse) on the tour. The large suitcase will be stored in the luggage compartment of the motor coach and will not be accessible during travel. The personal carry-on item must be small enough to fit in the overhead compartment or under the Participant’s seat.

The Company is not responsible for any personal property that is lost, stolen, or damaged during the Tour, including but not limited to, items left in the motor coach, hotel rooms, or at amusement parks. It is the sole responsibility of the Participant to safeguard their personal belongings.

Excess or oversized baggage may be refused at the sole discretion of the Company. Participants with baggage exceeding the stated limits may be subject to additional handling fees.

6. Indemnification

I agree to indemnify and hold harmless Roller Coast-Tours, LLC from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my involvement in the Tour, and to reimburse them for any such expenses incurred.

7. Medical Authorization

In the event of an injury or medical emergency, I authorize the Company to secure any necessary medical treatment. I agree to be financially responsible for all costs related to such medical treatment and transport. I understand the Company does not provide health insurance.

8. Photographic Release

I grant the Company the right to use, without compensation, any photographs, videos, or other recordings of me taken during the Tour for promotional, marketing, or any other legitimate purpose.

9. Tour Operations and Itinerary

Delays and Park Closures: The Company is not responsible for any delays caused by factors beyond its control, including but not limited to, traffic conditions, road closures, vehicle breakdowns, or inclement weather. Furthermore, the Company is not responsible for the operational status of any amusement park. Parks may close early, delay opening, or close specific attractions due to weather, accidents, incidents, or any other reason at their own discretion. No refunds or compensation will be issued for lost time or missed attractions due to such events.

Right to Alter Itinerary: In the event of significant delays, park closures, or any other unforeseen circumstances, I understand and agree that Roller Coast-Tours, LLC reserves the right to alter or modify the tour itinerary, including changing the order of park visits or substituting planned stops, at its sole discretion to ensure the safety and viability of the tour.

Responsibility for Arrival and Departure: I acknowledge that I am solely responsible for my own travel arrangements to the designated tour starting point and from the designated tour ending point. The Company is not responsible for any costs incurred due to missed or delayed flights, trains, buses, or any other mode of transportation. If I miss the scheduled departure for the start of the Tour, I am not entitled to a refund. Likewise, the Company is not responsible for ensuring I arrive at an airport or station in time for my departure at the end of the Tour.

Voluntary Departure from Tour: I understand that I may leave the Tour at any time and for any reason. However, should I choose to voluntarily leave the Tour before its official conclusion, I will not be permitted to re-join the Tour at a later time, and I will not be entitled to any refund, partial or full, for the unused portion of the tour. All costs associated with my early departure (including transportation and lodging) will be my sole responsibility.

10. Accommodation Policy

I understand and agree to the accommodation policies for the Tour. All hotel rooms are arranged on a shared basis for individuals booking as part of a group.

Groups (2 or more): Any participants booking together as a double, triple, quad, or larger group at the same time will be assigned to a shared hotel room(s) with adequate bedding for the group size, at the discretion of the Company and subject to hotel availability.

Requests for Additional Rooms: If any members of a group desire a private room separate from their group, an additional fee for the full cost of the extra room for the entire duration of the tour will be required. Such requests are subject to availability and must be arranged with the Company in advance.

Single Travelers: Any participant booking as a single traveler will be assigned their own private room. The tour price for a single traveler reflects this arrangement.

11. Governing Law

I agree that this Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any legal action or proceeding arising out of this Agreement shall be brought exclusively in the state or federal courts located in Florida.

12. Severability

Should any provision of this Agreement be held to be invalid or unenforceable, the remaining provisions shall continue to be valid and binding.

13. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes any and all prior oral or written promises, representations, or agreements.

14. Acknowledgment of Understanding

I have read this Participant Agreement, Liability Waiver, and Assumption of Risk in its entirety. I fully understand its terms and that I am giving up substantial legal rights, including my right to sue the Company for injuries resulting from the inherent risks of the Tour or the ordinary negligence of the Company. I acknowledge that I am signing this agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to 

the greatest extent allowed by law.

For Participants Under 18 Years of Age:

I, the parent or legal guardian of the above-named minor, have read and understood this Agreement and voluntarily agree to its terms and conditions on behalf of the minor. I hereby release the Company from any liability whatsoever arising out of the minor’s participation in the Tour and agree to indemnify and hold harmless the Company in the same manner as set forth above.
